FCC U.S. Agent Overview

 

 

Foreign manufacturers of radio-frequency (RF) devices regulated by the Federal Communications Commission (FCC) must appoint a U.S. Agent for Service of Process under 47 CFR §2.911(d)(7).

This requirement applies whether or not a foreign company has a physical presence in the United States.

 

As your designated FCC U.S. Agent, we act as the official point of contact between your company and the FCC. We receive all FCC communications on your behalf, process regulatory notices, and ensure compliant, timely handling of all FCC-related requests.

 

Our role includes:

 

  • Receiving FCC compliance, enforcement, and certification-related communications

  • Notifying you immediately of any FCC requests or required actions

  • Handling service of process, inspection notices, and regulatory correspondence

  • Ensuring you never miss an FCC deadline or compliance requirement

  • Providing the required written U.S. Agent Consent Letter affirming our acceptance of FCC responsibilities under 47 CFR §2.911(d)(7)

FCC U.S. Agent Requirements
 

Foreign manufacturers of RF devices subject to FCC rules must appoint a U.S. Agent located in the United States to fulfill Service of Process and FCC communication obligations.

 

Your FCC U.S. Agent must:

 

  • Be physically located in the United States

  • Be authorized to receive service of process on your behalf

  • Respond promptly to FCC inquiries or enforcement notices

  • Forward FCC correspondence, test requests, and compliance notifications

  • Be available for FCC communications during U.S. business hours

  • Provide a written, signed U.S. Agent Consent Letter acknowledging the responsibilities required under 47 CFR §2.911(d)(7)

  • Accept responsibility for the accuracy and completeness of responses to any FCC inquiries

 

 

Failure to appoint a qualified FCC U.S. Agent may delay device certification, authorization, or other regulatory approvals.

Your Responsibilities

 

  • Ensure all RF devices comply with applicable FCC technical standards

  • Maintain accurate test reports and technical documentation

  • Submit FCC equipment authorization applications (if required)

  • Respond to technical or regulatory questions related to your products

  • Manage all regulatory filings and certification records

  • Provide accurate information about your designated U.S. Agent in FCC filings

  • Supply complete, truthful product data and documentation to your U.S. Agent

Our Responsibilities as Your U.S. Agent

  • Serve as your designated U.S. Agent under 47 CFR §2.911(d)(7)

  • Provide and sign the required FCC U.S. Agent Consent Letter

  • Receive and acknowledge service of process on your behalf

  • Forward FCC enforcement notices, test requests, and compliance communications

  • Notify you immediately of any FCC correspondence or required actions

  • Accept responsibility for the accuracy and completeness of responses to all FCC inquiries

  • Maintain continuous availability during U.S. business hours

  • Support clear, timely communication between your company and the FCC

Scope of Service

Our FCC U.S. Agent service covers FCC regulatory correspondence and service of process only. Our address is registered with the FCC under 47 CFR §2.911(d)(7) as your U.S. Agent for Service of Process and cannot be used for any other purpose.

Our address may not be used as:

  • A manufacturer, importer, or “Distributed by” address on RF device labels, packaging, or product literature (47 CFR §2.925, §2.926, §15.19)

  • The U.S. importer of record or shipping address for CBP entries

  • A business mailing address for purposes unrelated to FCC regulatory correspondence

  • A warranty, service, or returns address for end customers

  • The responsible party address on the FCC equipment authorization grant or Supplier’s Declaration of Conformity (47 CFR §2.909, §2.929)

What to do instead

For product label addresses, responsible-party designation on FCC grants, importer-of-record designation, or U.S. distribution, please engage a U.S.-based importer, distributor, 3PL partner, or regulatory consultant separately from your U.S. Agent designation.
